1. About This Platform

HueMatrix Community (“the Platform”) is a file-sharing and social platform operated by HueMatrix 3D (ABN pending), based in Malanda, Queensland, Australia. The Platform allows Australian makers and designers to upload, share, download, and discuss 3D printable files including STL, 3MF, STEP, OBJ, and other supported formats.

The Platform is operated in accordance with Australian law, including the Copyright Act 1968 (Cth) and the Privacy Act 1988 (Cth).

2. Eligibility & Account Registration

2.1 Age Requirement

You must be at least 13 years of age to create an account. If you are under 18, you must have the consent of a parent or guardian.

2.2 Account Accuracy

You agree to provide accurate and truthful information when registering your account, including your username, email address, and location. Impersonating another person or entity is strictly prohibited.

2.3 Account Security

You are responsible for maintaining the security of your account and password. HueMatrix 3D is not liable for any loss or damage resulting from unauthorised access to your account.

3. User-Uploaded Content & Intellectual Property

3.1 Ownership Requirement

You may only upload files that you have the legal right to distribute. This means the file must be one of the following:

• An original work you created yourself
• A work you hold an explicit redistribution licence for
• A work released under a licence that permits redistribution (e.g. Creative Commons BY, BY-SA, or open source licences)

3.2 What You CANNOT Upload

The following content is strictly prohibited and will result in immediate removal and potential account termination:

• Files purchased from commercial marketplaces such as Printables (Pro/paid), Cults3D, MyMiniFactory, Etsy, Gambody, or similar platforms, unless the licence explicitly permits redistribution
• Files where the licence states “Personal Use Only”, “No Redistribution”, or similar restrictions
• Files created by another designer that you have printed but do not own the source file rights to
• Scanned or reverse-engineered versions of commercially licensed designs
• Any content that infringes the copyright, trademark, or intellectual property rights of any third party

3.3 Upload Declaration

By submitting a file, you confirm and agree to the following declaration:

“I confirm this file is my original work, or I hold explicit rights to distribute it under the licence I have selected. I understand that uploading commercially licensed files without redistribution rights is a breach of copyright and these Terms, and may result in account suspension or termination.”

3.4 Licence You Grant to HueMatrix Community

By uploading content, you grant HueMatrix 3D a non-exclusive, royalty-free, worldwide licence to host, display, and distribute your uploaded files and preview images on the Platform. This licence does not transfer ownership of your work.

3.5 DMCA / Copyright Takedown

If you believe content on the Platform infringes your copyright, please contact us at legal@huematrix3d.com.au with:

• Your name and contact details
• A description of the copyrighted work you believe has been infringed
• The URL of the infringing content on our Platform
• A statement that you have a good faith belief the use is not authorised

We will investigate and remove infringing content promptly in accordance with the Copyright Act 1968 (Cth).

4. Community Standards

4.1 Prohibited Content

The following content is not permitted on the Platform under any circumstances:

• Content that is sexually explicit or pornographic
• Weapons, firearms, or components designed to cause harm (including 3D printable weapons)
• Content promoting hatred, discrimination, or violence toward any person or group
• Malicious files, viruses, or code designed to cause harm
• Content that violates any applicable Australian law

4.2 Respectful Community

All users are expected to engage respectfully in comments and discussions. Harassment, bullying, spam, or abusive behaviour toward other users will result in account suspension or termination.

5. Downloads & Usage

Files downloaded from the Platform are subject to the licence specified by the uploader. HueMatrix 3D does not warrant that licences are accurately represented by uploaders. It is your responsibility to review the licence of any file you download before use.

Downloading files for personal, non-commercial use is permitted under most licences listed on the Platform. Commercial use may require additional permissions from the original creator.

6. Privacy

HueMatrix 3D collects and handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. We collect:

• Account information (email address, username, location)
• Uploaded files and associated metadata
• Usage data for platform improvement

7. Platform Availability & Modifications

HueMatrix 3D reserves the right to modify, suspend, or discontinue the Platform at any time without notice. We also reserve the right to update these Terms of Service. Continued use of the Platform following notification of changes constitutes acceptance of the updated Terms.

8. Limitation of Liability

To the maximum extent permitted by Australian law, HueMatrix 3D is not liable for:

• Any loss or damage arising from content uploaded by users
• Infringement of intellectual property rights by user-uploaded content
• Loss of data, files, or account access
• Any indirect, incidental, or consequential damages arising from use of the Platform

Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

9. Governing Law

These Terms of Service are governed by the laws of Queensland, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Queensland.
